Would a reasonable person in the same situation as Clark have felt that at the time this breach occurred the essential terms of his employment contract had changed to his detriment? Answer: YES.It is now time for Clark to sit down with an employment lawyer like your self and get legal advice on his next step. In the US employment is generally governed by the 'at will' doctrine, and while I understand the US has a concept similar to constructive dismissal,I believe it's fairly different. In fact, now you'll have me spending my Christmas vacation researching whether an American company could get away with doing this to an American employee (my guess is probably).
